The minister and president of the First Panel of the Federal Supreme Court (STF), Alexandre de Moraes, ruled on Monday 24, that the governor of São Paulo, Tarcísio de Freitas (Republicanos-SP) and the Legislative Assembly (Alesp) explain, in ten days, the model of civic-military schools created by the State.
The decision stems from a Direct Action of Unconstitutionality (ADI) filed last Thursday by the Workers’ Party (PT). The party asks the Court to declare the creation of civic-military schools unconstitutional, as it violates the model. principles of the Constitution, as well as generating high public costs and negatively impacting the development of students.
The party also claims that military personnel who will work in these new education centers will receive higher salaries than teachers in the state network.
At the beginning of the month, the PSOL also expressed its opinion on the case. The acronym claims that the program violates the federal Constitution, the Law on Education Guidelines and Basics (LDB) and national and state education plans. At the time, Minister Gilmar Mendes, rapporteur in the case, had also set ten days for the state government to make a statement.
Approved on May 27 this year by Tarcísio, the law establishing civic-military schools in São Paulo provides for the implementation of the institutions gradually and with public consultation.
The proposal aims to create between 50 and 100 schools in the State by transforming existing units. To achieve this goal, at least one military police officer will be assigned to each school. The units will be chosen based on the performance index (giving priority to those with numbers lower than the state average), the vulnerability indices and the school flow index (pass, fail and drop out).
“We have put an additional option on the menu, civic-military schools, to create an environment in which we have more security, where we can develop civic education, make discipline a vector for improving the quality of education. Membership it is voluntary. No one will be forced to study in a civic-military school. Only those who want will go there”, informed the governor.
