The official announcement on the amount that will differentiate consumers from drug dealers will be made this Wednesday 26th, when the trial should end
After forming a majority this Tuesday 25th to decriminalize the possession of marijuana for personal use, the ministers of the Federal Supreme Court (STF) must reach an agreement so that the maximum quantity of drug transported by the consumer is set at 40 grams. The announcement will however be made when the trial resumes on Wednesday 26th, when it should end.
The proposals presented so far range from 25 to 60 grams. At the end of this Tuesday’s session, the ministers announced that they will discuss to approve an intermediate measure, of 40 grams. In other words, according to this parameter, if a person is approached with more than the set amount, she can be prosecuted as a drug trafficker, which already carries a sentence of five to 15 years in prison.
Decriminalization does not mean that marijuana has been released into the country, nor that there will be legalized trade of the plant or flowers ready for consumption. The Supreme Court’s decision concerns only the possession of merit and will have practical effects once the trial is concluded and the sentence is published.
Even with the consensus of ministers on the quantity, a deadline will be established for the National Congress, together with other bodies, to regulate the issue. The agreed deadline, which will be officially announced on Wednesday, is 18 months for the legislative and executive powers to develop a public policy capable of legally separating the two behaviors.
The ministers have already agreed that the use of marijuana cannot be carried out in a public place and that the crime will be of an administrative nature, i.e. it cannot lead to criminal sanctions.
