A Justice of Minas Gerais annulled the marriage between a 36-year-old woman and a 92-year-old man because he believed it was a scam. Prosecutors concluded that the woman married the elderly man to fraudulently access social security and health benefits.

OR Public Prosecutor of Minas Gerais (MP-MG) and the Pension Institution of State Military Servants of the MG (IPSM) They filed a lawsuit to have the marriage annulled after discovering that the woman had a stable union and three children with the elder’s grandson, who was a soldier and had benefits that the ‘wife’ could have received.
When the MP-MG and IPSM filed the appeal, the entire family lived together: the wife, the partner, the three children of the couple and the elderly man, the grandfather of the partner and the great-grandfather of the children. In the appeal, in addition to the annulment of the marriage celebrated in 2016, the institutions also asked the woman for compensation for moral damages.
In the first instance trial, the Court rejected the request, after the suspect presented witnesses who convinced the district judge. The Prosecutor’s Office appealed and, in the second instance, the judges concluded that the woman had a stable union with the old man’s grandson and annulled the marriage.
The court rejected the claim for collective moral damages, but the woman lost the benefits to which she was entitled.
