The sentence includes 1 year and 4 months of imprisonment and an additional 4 months of detention, both in open regime.
Luciano Hang, businessman and owner of Lojas Havan, was convicted of defamation and insult against architect Humberto Tadeu Hickel by the First Special Criminal Chamber of the Court of Justice of Rio Grande do Sul, as reported by the newspaper O Globo.
The sentence includes 1 year and 4 months of imprisonment and another 4 months of detention, both in open regime. However, these sentences were converted into the provision of community services and the payment of compensation of 35 minimum wages to Hickel. In addition, Hang received a 20-day fine, with each day valued at 10 minimum wages, for a total of R$ 300,000.
The conflict between Hang and Hickel began when the architect led a campaign against the installation of a “statue of liberty”, a symbol of Lojas Havan, in Canela (RS). In response, Hang insulted Hickel, calling him a “leftist” and suggesting he “go to Cuba”, in an incident that occurred in 2020.
Hang told the newspaper O Globo that he intends to appeal the ruling. According to him, “Brazil is an extremely dangerous country for a businessman. In the quest to create jobs and development, people who use obsolete ideologies can be prosecuted to prevent the construction of projects. This is what is happening in this case. It is absurd that political debates are punished by taking away the right to freedom of expression.”
