The Offline Directory expands the debate on accessibility, inclusion and the rights of people with disabilities; The campaign combats discrimination and prejudice in the legal environment.
Lawyers with disabilities are faced with the capacityism of the judiciary and the lack of accessibility in public spaces, including digital ones, to defend the rights of the disabled population, despite the fact that Brazilian legislation is extensive, up-to-date and one of the most advanced in the world. A contrast that requires attention and solution – persons with disabilities are prevented from defending persons with disabilities in situations that repeat attacks on the fundamental rights of the defender and the defended -, and highlights how invisibility perpetuates discrimination and impedes the evolution of understanding about what it means to have a disability and, therefore, not be a de facto citizen.
This is one of the assessments of the jurists who participated this week, at the headquarters of the OAB São Paulo, of the ‘IV National Forum on the Rights of Persons with Disabilities’organized by the Federal Council of the OAB and the Commission for the Rights of Persons with Disabilities of the OAB SP. Warnings about exclusion in education – 67% of people with disabilities have no training beyond primary school – and in the workplace – only 500,000 workers with disabilities are registered – have reinforced the urgency of implementing the Brazilian law on the inclusion of people with disabilities (No. 13,146 /2015), in force in the country since January 2016, but still unknown to the majority of the 18 million Brazilians with disabilities, as well as members of public security and the judiciary itself.
The basis is the promise of accessibility in the legal context as a whole – an obligation, not a favor -, for example, the structural reforms of the Court of Justice of São Paulo, scheduled for completion in 2027, a deadline considered by some to be unfeasible. for conversations about realistic proposals and the need to make accessibility an immediate priority, not a future goal.
The fundamental role of the Offline Directory in the inclusion of people with disabilities, a question of respect for the laws, of bringing the right to those who need it, of the lawyer as a vector in this process; lack of respect for the legislation and the importance of more energetic action; the work of labor law as a positive example and jurisdiction were also discussed.
Countryside – During the forum, a campaign to combat ableism in the judiciary was presented, an initiative of the Special Commission for the Defense of Autistic Persons of the Federal Council of the OAB.
Under the title “Ableism is not cool”The action was approved in August by the Committee for the Rights of Persons with Disabilities in the Judiciary, of the National Council of Justice (CNJ), with its official launch scheduled for next Wednesday, the 18th, on the occasion of the 1st National Meeting of the Committee for the Rights of Persons with Disabilities in the Judiciary.
