Moraes, Dino, Mendes and Zanin witness the team’s defeat in Brasilia


The ministers of the STF, who judge the process that defines the future of Ednaldo Rodrigues in command of the CBF, were in a box at the Mané Garrincha stadium

Among the audience of 60,139 people there were personalities from the judiciary, including ministers of Federal Supreme Court (STF) Alexander of Moraes, Flavio Dino, Gilmar Mendes AND Cristiano Zaninand national politics, as Minister of the Secretariat for Social Communications Paolo Pimenta.

The three watched the match from a stage in the Mané Garrincha stadium. Dino also wore the Botafogo shirt, the club he supports. He was able to see Botafogo’s Luiz Henrique enter, in the 24th minute of the second half, provide an assist and score a goal, in four minutes.

Also present on the stage was the Prime Minister of the Attorney General’s Office (AGU), Jorge Messias. He also wore the shirt of his favorite team, Sport. Unlike Dino and Messias, Alexandre de Moraes of Corinthians, Cristiano Zanin of Sao Paulo and Paulo Pimenta of Colorado did not wear their clubs’ uniforms.



The presence of STF ministers at the Brazilian team’s match comes six days after the interruption of the process defining the future of the incumbent president of the CBF, Ednaldo Rodrigues. Minister Flávio Dino asked for a review (more time to analyze).

Gilmar Mendes is the rapporteur on the case. He was the only one to vote when faced with Dino’s request. On the agenda is the judgment on the merits of an injunction issued by the same minister-rapporteur who suspended judicial decisions which deem that the Public Prosecutor cannot intervene in sports entities, as the RJ deputy did when Ednaldo was elected. At the time, in 2022, a Conduct Adjustment Term (TAC) was signed to provide stability for the CBF.

Following the preliminary decision, in January this year, Mendes reconfirmed Ednaldo as president of the CBF. He had been removed by the RJ Judicial Court. In his vote, Minister Gilmar Mendes reiterated what was already expressed in the injunction.

The judgment of the action also involves the possibility of interference by the Judiciary (and the Prosecutor’s Office) in the autonomy of sports bodies, especially in electoral matters. For Gilmar Mendes, the cases where it is worth interfering are only when internal rules and practices violate the Constitution and relevant legislation or when the action is based on investigations into criminal and administrative wrongdoings related to the sporting entity.

Again according to what was expressed by the minister in his vote, sporting activities have a significant social and public interest, which legitimizes the deputy’s action both through extrajudicial means (civil investigations, TAC, recommendations) and through judicial means (public civil actions).

Mendes believes that the TJ-RJ only sought to “legitimize an even more serious and intense external intervention in the CBF’s activity” when it removed Ednaldo and appointed an intervener. At the time, the intervention was frowned upon by Conmebol and FIFA.
