Enel stated that “the company reaffirms its commitment to its customers and reiterates that it will continue to invest to provide quality energy and face the advancement of climate events”. THE Ministry of Mines and Energy he has not responded to date.
The Secretary of Communication of the Presidency of the Republic specifies, in a note, that President Lula established on 14 October (after the second great blackout in Sao Paulo) that Comptroller General of the Union (CGU) carry out an audit at Aneel to investigate a possible failure in Enel’s inspection.
Al State, the CPI rapporteur, Carla Morando (PSDB), specified that, after a year, the path is still that of the Union’s intervention, “with the opening of the accounts and also an audit, from 2018 to 2023, because this highlights a much higher profit compared to previous years, to the detriment of having no permanent employees, but only external employees who they hire when they deem it appropriate”.
Enel’s final CPI report was presented just weeks after last year’s November 3 blackout, which left the capital of Sao Paulo and cities in Greater Sao Paulo partially without electricity for almost a week. Several trees fell on power lines due to the wind recorded that day, but the CPI clarified that the problem was not just climate-related.
“The damage resulting from the events of November 3, therefore, did not occur exclusively due to bad weather, as the concessionaire tried to justify, nor due to the tree issue alone. As demonstrated, the harmful effects of the meteorological event were seriously aggravated to due to the previous behaviors adopted by the company, such as the constant reduction of staff, the lack of material to carry out its activities and the policy of investing in capex (capital expenditure) to the detriment of opex (expenditure operational)”, states an extract of the document in a report made by Carla Morando.
Again according to the CPI notes, the number of Enel employees fell from 8 thousand to 3.9 thousand between 2018 and 2023. “The company’s thesis is that this was compensated, in some way, with outsourcing”, we read in the document.

Aneel informed the CPI that he had imposed fines totaling 157.2 million reals on Enel’s coffers. Procon-SP also sent documents to parliamentarians in São Paulo with a list of sanctions imposed, worth R$109.1 million. The values refer to fines between 2018 and 2023. In the updated value, the numbers are around R$400 million and have become a legal dispute. “Yet the concessionaire continues to present a history of complaints. The situation has already become unsustainable”, underlines the commission document.
Lula becomes the target of a protest motion for having signaled the renewal of the Enel contract

Four months later, a new storm left thousands of homes without electricity in the capital Sao Paulo, affecting 3.1 million people, according to the same company’s data. “Enel Distribuição São Paulo clarifies that the windstorm that hit the company’s concession area on October 11, with gusts of up to 107.6 km/h, was the strongest in the São Paulo metropolitan region in recent 30 years, according to the Civil Protection, and with a greater impact on the electricity distribution network”, informed the concessionaire.
The federal government said so Estadao that the Lula government “was not responsible for the concession, nor for the appointment of the current directors of Aneel, much less of the state agency of São Paulo, responsible for supervision”.
