So far, six of the 11 ministers have voted against calls for the former athlete’s freedom
On Friday the 22nd, the Federal Supreme Court (STF) formed the majority to keep Robinho in prison. The former player has been in Penitentiary II of Tremembé, in the interior of Sao Paulo, since March this year, where he is serving a nine-year sentence for rape committed in Italy.

As of this article’s last update, six of the 11 ministers had voted against calls for the former athlete’s freedom. They are: Luiz Fux, rapporteur of the case, Edson Fachin, Luís Roberto Barroso, Cristiano Zanin, Cármen Lúcia and Alexandre de Moraes.
Only minister Gilmar Mendes spoke in favor of habeas corpus for Robinho. The process in the STF is not yet finished, ministers Dias Toffoli, Nunes Marques, André Mendonça and Flávio Dino still have to vote.
For a week the Court has been analyzing the habeas corpus requests made by the former player’s defense. The lawyers question the legality of the arrest after the Superior Court of Justice (STJ) ordered the execution of the sentence for the crime on Brazilian soil and ask that Robinho serve the sentence in freedom until all resources for appeal.

Robinho was convicted of raping a young Albanian girl in Italy in 2013 when he was playing for AC Milan. The case occurred in an Italian nightclub, and five other friends of the former player were also involved. One of them, Roberto Falco, is also in prison. Four others were not tried. In Italy, Robinho has been convicted in three cases.
Because he had returned to Brazil and the country does not extradite Brazilian citizens, the Italian court asked that the nine-year prison sentence be served in Brazil. (*With information from Estadão Conteúdo)
