The president of the Constitution and Justice Commission (CCJ) of the Chamber, the deputy Caroline de Toni (PL-SC), has chosen the deputy Paulo Bilynskyj (PL-SP) as rapporteur of the Proposal for Amendment to the Constitution (PEC) which prohibits participation of military personnel to politics.
The PEC, drafted by MP Perpétua Almeida (PCdoB-AC), was presented in 2021 as a reaction to the growing presence of military personnel in the government of former President Jair Bolsonaro (PL). The text establishes that, to occupy positions in the civil public administration, military personnel must abandon their military career.
“The objective is to protect the Armed Forces (FFAA) from the normal conflicts inherent in politics and strengthen the character of the Navy, Army and Air Force as permanent institutions of the State and not of governments,” explained the MP.
The São Paulo MP is tasked with trying to negotiate changes to the original text of the PEC a week after the Federal Police (PF) indicted 37 people for planning a coup, including 25 active and reserve military personnel and the former president himself, as he and the CCJ leader are politically close.
Although he has not yet commented on his appointment as speaker, Bilynsky defended the former president from the investigation. “In the PF’s 800-page report there is no evidence of President Bolsonaro’s participation in any event,” he said on a social network.
There is another similar PEC in the Senate, drafted by Senator Jacques Wagner (PT-BA), which prohibits active military personnel from running for office. The project has already been approved by the CCJ of the Chamber and is now awaiting a vote in the plenary.
The text proposes that active military personnel be forced to move into the unpaid reserve if they want to participate in elections, with no possibility of returning to service if they are not elected. The exception is military personnel with more than 35 years of service, who can opt for paid reserve service.
