THE Federal Supreme Court (STF) will resume the process that defines the future of Ednaldo Rodrigues In Brazilian Football Confederation (CBF) on March 14, as planned by the minister’s office Flavio Dinowho asked to see the files in October. The court will consider whether to maintain or quash an injunction that restored the director to command of the entity in January.
The measure was issued by Gilmar Mendes, who was also the only one to vote before the trial was suspended. The consideration of the case in the plenary took place only for the sixth time that it was on the agenda. The reason for the postponements was a long series of other cases at the Court.
Gilmar Mendes maintained his position in favor of Ednaldo’s mandate and argued that the STF should prohibit state intervention in the internal matters of sports bodies, “particularly in those relating to the autonomy and self-government” of these institutions .
According to the minister, intervention should only take place when a body approves rules that violate the Constitution or legislation; or in cases of investigation of criminal and administrative cases.
Gilmar Mendes’ vote is fundamental in the dispute between the Court of Justice (TJ-RJ) and the Public Prosecutor of Rio de Janeiro (MP-RJ). Before Ednaldo’s election, the RJ MP had questioned the changes to the internal rules of the CBF. When Ednaldo was elected, a Term of Conduct Adjustment (TAC) was signed between the entity and the Attorney General’s Office, to ensure stability in the elections.
However, in December 2023, the TJ-RJ judged the legality of the TAC and canceled the CBF assemblies that had changed the electoral format in force at the time of Ednaldo’s election. Therefore, the president was removed from office, which sparked concern from Conmebol and FIFA, who even appointed an intervener.
In a first request, made by the Social Democratic Party (PSD), STF minister AndrĆ© MendonƧa denied Ednaldo’s return to office. A month later, in January 2024, Gilmar Mendes openly accepted the request of the Communist Party of Brazil (PCdoB) to reinstate Ednaldo as president of the CBF, after the Attorney General’s Office (PGR) and the Attorney General’s Office (AGU) had published favorable opinions to the suspension of the decision of the court that removed him.
The request for an opinion from Minister Flavio Dino was made given the complexity of the case. “Really very confusing. A public civil case from 2017, a sentence, a CT scan (Conduct adjustment deadline), an appeal from 2023, which refers to the first issue, the validity and effectiveness of the decision of the TJ of Rio de Janeiro,” he explained.
The CBF changes its statute and Ronaldo enters the race for president
Although the trial is not resumed, the behind-the-scenes politics of the CBF continues. A change to the organization’s statute was recently approved, guaranteeing that the presidents of the confederation can be re-elected twice, remaining in office for three consecutive terms. The law in force until then allowed him to serve only two consecutive terms, with only one re-election.
The decision was approved unanimously by the federations. The idea is to bring the institution’s new statute closer to other football regulatory bodies such as Conmebol and FIFA, which follow the same rule.
In the next elections, unlike 2017, when Ednaldo had no competitors, Ronaldo FenƓmeno will run. The former player has already expressed support, choosing four-time champion Mauro Silva among his vice-presidents.
