The Spanish government has approved a bill on Tuesday that imposes heavy fines for companies that use the contents generated by artificial intelligence (AI) without labeling it correctly as such, in an attempt to curb the use of the so -called “deep”.
The project adopts the guidelines of the historical law of the European Union AI, imposing rigorous obligations of transparency to high -risk artificial intelligence systems, told the minister of digital transformation, Oscar Lopez, to journalists.
“Artificial intelligence is a very powerful tool that can be used to improve our life … or to spread disinformation and attack democracy,” he said.
Spain is among the first EU countries to implement the rules of the blockade, considered more complete in the United States system, which depends widely on voluntary compliance and a quilt of state regulations.
Lopez added that everyone is susceptible to the attacks of “deepfake” – a term that includes videos, photographs or audios that have been modified or generated by AI algorithms, but are presented as real.
The Spanish bill, which must be approved by the lower chamber, classifies the correct labeling of the content IA as a “serious infringement” which can lead to fines of up to 35 million euros (38.2 million dollars) or 7% of global annual revenues.
Ensuring that AMA systems have not damaged the company has been a priority for regulators since Openai revealed Chatgpt at the end of 2022, which impressed users by involving them in human conversations and carrying out other tasks.
The bill also prohibits other practices, such as the use of subliminal techniques – sounds and imperceptible images – to manipulate vulnerable groups. Lopez has mentioned as examples of chatbots that encourage people with vices to play or toys that encourage children to perform for dangerous challenges.
The law would also prevent organizations from classifying people through their biometric data using the IA by classifying them based on their behavior or personal characteristics to give them access to the benefits or evaluate the risk of committing a crime.
However, the authorities would however be authorized to use real biometric surveillance in public spaces for national security reasons.
The application of the new rules will be borne by the new AI supervision agency, with the exception of specific cases involving data privacy, crimes, elections, classifications of credit, insurance or capital market systems, which will be controlled by their respective inspection bodies.
