Moraes denies a request for flexibility of the penalty for Daniel Silveira

The Minister of the Supreme Court (STF) Alexandre de Moraes denied Wednesday 2, the request for the defense of the former deputy Daniel Silveira to serve the sentence in a harmonized semi-aperture regime. The defense said that the former parliamentarian must work to support the family.

The method of conformity of the sentences allows prisoners to go to work and sleep at home until they remain under electronic monitoring. Silveira’s defense also claimed that the former deputy has maintained good behavior.

Silveira has been arrested since February 2023 Last Friday, 28, the Court’s ministers constituted the majority to maintain their former deputy in prison by rejecting a new request for conditional freedom.

Representative of the case, Moraes underlined in his vote that, when it was released, the former parliamentarian violated “on several occasions” the conditions imposed, without presenting “any minimally plausible topic for this”. The Flávio Dino ministers, Dias Toffoli, Carmen Lúcia, Edson Fachin, Cristiano Zanin and Luis Roberto Barroso accompanied the speaker. The trial takes place in the virtual plenary of the Supreme Court and is still waiting for the votes of Gilmar Mendes, Luiz Fux, Nunes Marques and André Mendonça.

Last month, Moraes had already denied another request for defense so that Silveira could temporarily leave the semi -open regime and spend Easter with the family. In the decision, the minister said that the former deputy showed “total lack of respect for the judiciary”.
