What PGR reports
The Prosecutor General Office (PGR) accuses the group of propagating false news on the electoral process and conducting computer attacks on the institutions and authorities representing threats to the plans of the organization of the coup.
Pgr’s complaint states that the seven defendants were “aware of the wider plan of the organization and effectiveness of their actions to promote social instability and consumption of institutional breakage”.
Moraes underlined that the actions of the nucleus were connected to the political nucleus, which includes Bolsonaro himself, with the aim of undermining the credibility of the elections and the judiciary. The speaker evaluated that the PGR report contains the tests that weighs against all the accused, which would justify the opening of the criminal action.
“The actions obtain even more relief when observing the consonance between the public speeches of Jair Messias Bolsonaro and the objectives chosen by the cell infiltrated at the Brazilian Intelligence Agency,” said Moraes.
Accusations
In his complaint, the PGR charged to the seven defendants the crimes of violent abolition of the state of democratic law (sentence of 4-8 years in prison), coup d’état (sentence from four to 12 years), criminal organization (sentence from three to eight years), criminal sentence (sentence from three to eight years), qualified damage (from six months to three years) and deterioration of equity (one at three years).
The defendant can appeal to the decision on the Supreme Court itself.
Now, the criminal action will enter the procedural education phase, when auditions are made for the collection of evidence and presentations of testimonies, including the defendants.
After this phase, the parties must present their final accusations and the case goes to the trial. If condemned, each defendant will receive a specific phrase from which he can also appeal.
