The defenders of the text affirm that the proposal simplifies the authorization for lower impact activities; The organizations of the Ministry of the Environment and the Sector affirm that the “Viola La Constitution” project
An amendment to the bill 2159/2021, which proposes changes in environmental licenses, can facilitate the deforestation of mature forests in the Atlantic forest. The PL was approved at the Senate plenary on Wednesday and now goes to the Chamber. According to his supporters, the simplify proposal and flexes the licenses for the activities considered less impact.
The Ministry of the Environment states that the new proposal “faces the Constitution”, a position shared also by sector organizations.
The amendment that affects the Atlantic Forest requires the revocation of paragraphs 1 and 2 of article 14 of the bioma law, which provides for rules to authorize deforestation in areas of primary and secondary vegetation, and on average advanced regeneration, under the justification of the elimination of conflicts with the future license on the license.
For Senator Tereza Cristina (Progressives), speaker of the PL, the amendment “does not change anything of what is done today” and was included in the framework of the licenses “only to standardize the legal procedures”, he said to the Estadão. The report sought the author of the amendment, Senator Jayme Campos (Brazil-Mt Union), but has not received a response.
The inclusion complies with a request from the Brazilian association of state environmental entities (Abema), which disputes the need for consent of Ibama, federal agency, for authorizations for the suppression of vegetation by the States. “The conflict with the federal license body, which recurrently issues the infraral rules and the decision orders that hinder the regular procedure of the environmental license processes conducted by the States, has been recurring, which is why it is essential that the law is in uniform”, says the letter to the department00 PL, issued by the association on the 15th.
The articles revoked by the state of amendment according to which the analysis of the requests for the suppression of the vegetation in the Atlantic Forest depends on the states, but can adapt to the preventive consent of Ibama or the municipal environmental agency, provided that the Municipality in question meets the minimum requirements, such as having an environmental advice that is a deliberative and main plan.
For the Atlantic Forest of NGO SOS, the amendment proposal is unconstitutional and facilitates the approval of requests for the suppression of vegetation in the areas where deforestation is prohibited, except in specific cases. Other entities, such as the Pact for the restoration of the Atlantic Forest, also the climate observatory and the socio -ambiental institution (ISA) oppose the amendment.
