What is the “internet crime” considered? What is the border, within the law, so that an arbitrary, offensive or harmful attitude is framed as a case for digital law?

Your crime on the internet is the one that, existing, is necessary to exist devices such as computers. For example: invasion of the electronic device. What happens is that today many crimes are committed on the internet, having in many cases the increase in the penalty, such as slander, injuries and defamation. If you take your computer, your mobile phone and the tablet still exist? YES! Have they increased in the middle to have been the Internet? YES. This is what we call crimes whose platform can be the internet and somehow have been “incorporated” in digital law. The same rules valid for common law are valid for digital law. Moral damage is an example: the victim can understand that the author has passed. The problem is the third interlocutor, the judge, who at a discretionary level will say in pain if he had damage or a nuisance.

What is the legal basis for cases so called “digital law”? Can the Brazilian constitution itself and the codes of law can follow/provide these requests (and that change very quickly)?

The basis for Brazilian legal law is the Internet Civil Marco and our Criminal, Civil, Labor and the consumer protection code, applied within the internet prism. The problem of Brazil is today in the equation of justice at the time of the Internet and in the ignorance of the magistrates on the subject.

You have already said that, more than one lawyer, he considers himself a resolution of conflicts. Can you explain in what sense is the right to win by strategy?

I use negotiation and mediation a lot. I have to look for solutions often outside the case. However, I get hostage at the time of justice. Thanks to my pioneering in the area and the dialogue that I have always established with artists, journalists and profiles, with it, for example, a removal of publication through a direct approach, obviously using neurolinguistic relationship and programming techniques.

We live in a company that controls fear, especially on the internet, a judges’ factory. What is your biggest fear?

My fear is chicken and plane. And it’s not a joke.

How did you recover from Burnout syndrome and how did you manage to organize priorities in your life?

Understand that time is our greatest good and it gives me the well -deserved value. If I am considered the best, it is contradicted by myself, I don’t appreciate my time and my job. Today I choose cases and people choose if the price is right or not.

How do you like spending free time? Where do you renew your energies?

By resting, deepening me in stoicism and far from the spotlight and civilization. It appears less and less and only when necessary. Celero peace and silence.

The family is the basis of everything. We have wasted a lot of time with those who do not deserve our time and stop living moments with fantastic people for lack of time. I always speak: thanks to every disappointment … it makes you redistribute your time for those who are really up to him.
