In a message of justification of the veto, Lula quoted “contrary to the public interest” and “unconstitutionality”, based on the opinions presented by the Ministry of Justice and Public Security, by the Prosecutor General of the Union (AGU), the Ministry of Finance and the Ministry of Planning and Budget.

According to the government, the expansion of the number of parliamentarians would increase the mandatory expenses without the due estimate of the budget impact, source of costs or compensation measures. The estimated impact on public coffers exceeds $ 140 million a year.

Among the impacts are the parliamentary amendments that the new representatives would have the right to appoint the Union’s budget. The number of state deputies would also have amendments, since the Constitution provides that the legislative assemblies have the state representation three times in the Chamber – with additional rules if the triple exceeds 36 chairs.

The proposal satisfied the determination of the Supreme Federal Court (STF) to the congress to review the distribution of the vacancies of the Chamber according to the population of each state. The constitution is expected to be the periodic correction of the number of deputies in relation to the population of each federative unit and the current number was attributed on the basis of the 1986 census.

In this redistribution, some states that have a population growth should earn more parliamentarians, while others would lose vacant places. For no state bench to lose the chairs, the congress proposed the increase in vacant places rather than redistributing the current 513.

If the presidential veto is maintained, the decision of the Supreme Court provides that the redistribution of the vacancies is made by Superior Electoral Court (TSE) Until October 1st.
