The United States Court considers illegal US tariffs

The Federal Court of Appeal has decided that most of the rates imposed by President Donald Trump are illegal, but confirmed the charge to the government of appealing to the decision. A Federal Court of the United States established on Friday (29/08) that most of the rates of President Donald Trump, which affect several commercial partners, are illegal.




The Court defined that the rates could remain in force until October 14, so that the government can appeal to the decision to the Supreme Court.

The decision represents a blow for the president, who used rates as a global economic policy tool.

Since he returned to the presidency in January, Trump has convened the international law on economic emergency powers (IEPA) to impose rates to almost all US commercial partners. The law grants the President the power to face unusual and extraordinary threats during national emergencies.

Trump said in April that it matters more than exporting the United States was an emergency. The country has more than exports for decades.

“The law gives a significant authority to the president to take a series of actions in response to a declared national emergency, but none of these actions explicitly includes the power to impose rates, taxes or the similar or the power to tax,” said the Court.

The International Court of International Trade of the United States had already established in May that Trump had passed his authority with general global taxes.
