The defendants are not required to attend the court, but the former president spoke with the allies of the possibility of going to the sessions as an attempt to demonstrate the force




Former president Jair Bolsonaro and the other seven defendants for state -deployed attempts in the criminal case that is starting to be tried on Tuesday (2/9) by the Supreme Court (STF) are not required to attend the Court for the sessions. (See how to look at the process)

Formally, they will be represented by their lawyers, who will have an hour to present the defense of their customers.

Bolsonaro, however, can choose to go to court, just like the other defendants.

In his case, however, due to the domestic arrest, he should have asked the speaker minister Alexandre de Moraes, according to the criminal code.

According to a report in the newspaper Folha de S. Paulo, the former president would have assessed the possibility of going to the sessions, at least the first and last day, as an attempt to demonstrate strength.

The eight defendants are part of the “crucial nucleus” so called of the alleged criminal organization which, according to the accusation, would have tried to subvert the result of the 2022 elections, won by the current president Luiz Inacio Lula da Silva (PT). Everyone deny the accusations.

What is Bolsonaro accused?

The PGR asked for the condemnation of Bolsonaro for the accusations of the main armed criminal organization; attempted violent abolition of the state of democratic law; coup d’état; Damage against the Heritage Union; and deterioration of the listed heritage.

Bolsonaro’s defense told his latest accusations to the Supreme Court that the accusation is “absurd” and that there is no evidence to transform the former president into plans to kill the authorities “and much less in the documents of January 8”, when the supporters of the president invaded the headquarters of the three powers in Brasilia.

If sentenced for all these crimes, the sentence against the former president can exceed 40 years.

Bolsonaro’s defense said he was “surprised” with the chamber’s arrest decree and said the former president “did not interrup any measure”.
