This week, the deputy federal Luiz Gastão (PSD-CE), speaker of the project of the Legislative Decree (PDL) n. 3/2025, issued a favorable opinion for the reversal of resolution no. 258/2024.
The text was approved by social security, social well -being, childhood, adolescence and family and justice committees and citizenship.
According to the opinion, Gastão claims that children under the age of 16 have no autonomy to make decisions and, therefore, abortion must be made to the mandatory presentation of a police relationship or after the victim was authorized by the court.
“The exemption of the judicial authorization, in my opinion, constitutes an affront to the right of access of the child not yet born to the judiciary,” says the speaker, according to the opinion.
For Conanda, not even the parents of the victim or legal guardians must be warned when he is at risk, where he is suspected of sexual violence within the family environment.
Another point criticized by Gastão concerns the time limit so that abortion can be done. For him, Conanda cannot fail to indicate it, which, according to the speaker, “in practice, would authorize abortion in cases where pregnancy is close to 40 weeks”.
Conanda’s resolution provides that the gestation time should not be an obstacle to prevent abortion, which should be performed without the need to communicate to the Protection Council.
Since February, the proposal has not progressed in the Chamber, taking up at the end of last month. On 27, the deputy Chris Tonietto (PL-RJ), in articulation with other parliamentarians, asked to vote on the text on the text. If approved, the regime shortens the processing, making the proposal directed to the plenary vote, without approving the analysis of the commissions.
In the order addressed to the rapporteur, the group of deputies claims that the Conanda highlight the “family power”, presents “inappropriate interpretations of the right to the objection of consciousness for the practice of abortion” and gives greater decision -making power to children and adolescents than they do, according to civil legislation.
In addition, the conservative wing highlights in the document, in line with other groups called pro-Vita, that the resolution of the Council violates the right to life and physical integrity of the fetus.
The deputies also affirm that “abortion should not be right, as the regulatory act says”, since the federal constitution guarantees the inviolability of the right to life also to the fetuses.
Among the authors of the PDL are Eduardo Bolsonaro (PL-SP), Bia Kicis (PL-DF) and Chris Tonietto (PL-RJ), as well as Marco Feliciano (PL-SP) and Zé Trovão (PL-SC). There are also parliamentarians of other acronyms, such as MDB, PSD, Avanta, União Brazil, Somos and Republicans, chaired by Bishop Marcos Pereira, of the universal Church of the Kingdom of God.
