Understand the meaning of the toga, “black cover” used by the Stf ministers

The use of toga arrived in Brazil for the influence of Portuguese and originates in ancient Rome

Toga, a kind of “black cover”, is the official costume used by the ministers of Supreme Federal Court (STF) During sessions and solemnity. Black, long and used on the shoulders, the piece symbolizes the transition of the individual to the institutional figure, which represents the commitment to justice and the application of the law according to the Constitution.

Although Stf ministers use the black toga exclusively, other colors are adopted at different levels of legal hierarchy, each with its own symbolism:

  • Red: Used by public ministries and ministries, it represents zeal for the police.
  • White: Used by the judges, it symbolizes impartiality and neutrality in the interpretation of legislation.
  • Green: He wears defenders and public lawyers, referring to the hope of resolving conflicts through justice.

The symbolic value of toga was interpreted by the American researcher Joseph Campbell in his book “The Power of the Myth”. “When a judge enters the court of the court and everyone gets up, they are not getting up to the individual, but to the toga wears and the role he will play.”

In an interview with Estadãothe history teacher of Federal University of Bahia (UFBA) Vitor Porto explained that the use of toga dates back to ancient Rome and that his adoption in the Stf took place between 1909 and 1940.

“The judges of the western world have inherited the use of the toga of the Roman tradition. In Rome, it was common for the magistrates to use the Togas to stand out from the other members of the Court, reporting their authority to make decisions such as declaring a guilty or innocent accused,” said the professor.

“In the case of Brazil, this tradition has come through Portugal, from where we specifically inherited the use of black toga. Therefore, while customs originated in Roman civilization, in Brazil it was incorporated by the direct influence of Portuguese legal culture,” said the historian.

The Togas were originally made of wool and subsequently were made of linen. They are currently produced in silk in satin and tailor -made by tailors taken through offers. There is also a shorter version called “Summer Toga”, used in less formal StF sessions. In the past, the boss was accompanied by a hat, which over time fell into disuse.
