Reporting errors, homophobic posts and anti-arbitration crimes lead to complaints to the Court; see possible sanctions

The Prosecutor’s Office Superior Court of Sports Justice (STJD) reported Ramón Abatti Abel AND Ilbert Estevam da Silvamain referee and VAR of the match between Saint Paul and Palmeiras, marked by refereeing controversies. They have also been the subject of complaints Carlo Belmonte AND Rui Costasporting director and manager of San Paolo, as well as Vittorio RoquePalmeiras striker.

Abatti Abel and Estevam da Silva were subject to article 259 of the Brazilian Code of Sports Justice (CBJD), which provides for a suspension of 15 to 120 days and a fine of R$100 to R$1,000 for “failing to observe the rules of sport”.

According to the complaint of the Public Prosecutor, to which the Estadao accessed, the match “presented a series of violations of the rules of the game and the VAR Protocol”. The text reports the following moves as errors: Allan’s failure to award a penalty to Tapia; the failure to send off Andreas Pereira for a foul on Marcos Antônio; Estevam da Silva’s failure to recommend the revision of plays.



The Prosecutor’s Office also underlined that there were no indications for a review of the attack on Tapia, thirteen minutes into the second half. The complaint highlights that the Chilean and Gustavo Gomez turned their backs on Abatti Abel, making VAR intervention necessary in a possible sending off of the Palmeiras defender.

“This is not a hypothesis of mere errors included within the scope of the technical discretion of the arbitration, but rather of a set of known and gross errors, as recognized by the reaction of the CBF Arbitration Commission itself, which directly influence the full development of the sporting spectacle, the results of the matches and, ultimately, the health of the championships themselves”, we read in an extract of the complaint.

Arbitration and post-homophobic crimes reported by the Prosecutor’s Office

Carlos Belmonte and Rui Costa are reported for conduct contrary to discipline or sporting ethics, pursuant to article 258 of the CBJD. In the summary, the San Paolo cylinders were mentioned, who insulted the refereeing team.

“Take it back, what a shame there. The VAR didn’t come”, Belmonte would have said, at the end of the match, in the tunnel of the MorumBis dressing room. The phrase is attributed to Rui Costa: “It will be a shame.” The article provides for a suspension of 15 to 180 days for each subject.

Vitor Roque is also among the defendants. After Palmeiras’ victory, the club’s striker made a homophobic post, in which a tiger holds the head of a deer, a reference to himself (since his nickname is “tigrinho”) and his Sao Paulo rivals.

Roque was included in article 243-G of the CBJD, along with article 139 of the General Regulations of Competitions of the Brazilian Football Confederation (CBF). The texts provide punishments for discriminatory acts.

The sanction ranges from a suspension of five to ten games, as well as a fine of R$ 100 to R$ 100 thousand.

San Paolo and Palmeiras were also reported for the delay in starting the match in the first and second half. The Sao Paulo team was delayed, in total, by four minutes. Palmeira, six. The CBJD provides a fine of R$100.00 to R$1,000.00 for each minute of delay.

Now the STJD Court analyzes whether to accept the complaints and judge the accusations.
