Court acquits all defendants in Ninho fire case


The tragedy occurred on February 8, 2019 and killed ten Flamengo youth players




Last Tuesday (21st) the Rio Court acquitted all the defendants in the Ninho do Urubu fire case. In the decision, Judge Tiago Fernandes de Barros, of the 36th Capital District Criminal Court, said the investigation did not substantiate the report presented by the Civil Police. In this way, seven people were acquitted by the magistrate.

The judge stressed that none of the defendants had direct duties on the maintenance or electrical safety of the modules. Therefore, there was no way to hold them criminally responsible. Furthermore, the judge highlighted that the Prosecutor’s Office formulated the complaint in an exhaustive and generic way, without individualizing behaviors and without demonstrating a concrete violation of the objective duty of diligence.

The fire occurred on 8 February 2019 and killed ten players from Flamengo’s youth sector. The young people slept inside a temporary structure inside a container. The fire is suspected to have started due to a short circuit in an air conditioner. In this way the fire spread. At the time, according to the municipality, Ninho do Urubu did not have an operating license.

The young people were between 14 and 16 years old. Three others were injured. In this way, a total of 11 people were responsible for the crimes of qualified arson and serious bodily injury to three victims. In addition to the seven people acquitted, four others had already been acquitted before Tuesday’s decision.
