According to a Spanish newspaper, the locations of the fingerprints corroborate the testimony of the woman accusing the Brazilian player
The Catalan police continue to collect evidence for the case against Daniele Alves, accused of sexual assault against a 23-year-old woman in Barcelona. According to the newspaper El Periodicothe researchers found seven fingerprints of the alleged victim in the disco bathroom suttonwhere the rape took place. The athlete denies the allegations.
Again according to the Spanish vehicle, the place and positions in which the fingerprints were found will be decisive for the progress of the preliminary investigation, in order to clarify what happened in the toilet of the disco between dawn on 30 and 31 December.
Usually, a fingerprint search aims to identify who was at the scene. In this case, however, the defense and the prosecution confirm that they were in the bathroom. In this way, the investigation aims to reveal whether the descriptions of violence actually fit the scene.
The locations of the fingerprints corroborate the version declared and repeated, without retreat, by the victim in his testimony to the court. On the other hand, Daniel Alves would have contradicted himself in each of the testimonies. One of the defense’s justifications for this is that the player wanted to hide his infidelity from the woman.
Daniel Alves’ lawyers intend to appeal against the preventive detention until next Monday. The intention is that the player, who has been arrested for a week, can leave prison using a sort of “electronic bracelet”, handing over his passport and appearing in court whenever required.
THE DANIELE ALVES CASE
On January 20, Judge Maria Concepción Canton Martín ordered the arrest of Daniel Alves. He was arrested while testifying in the case of sexual assault against a woman in the early hours of December 30th. The Public Prosecutor’s Office requested the preventive detention of the 39-year-old athlete, without the right to bail, and the holder of the Investigative Court 15 of Barcelona accepted the request, ordering the detention.
The accusation refers to an episode that allegedly took place at the Sutton nightclub in Barcelona, Spain. The athlete, who defended the Brazilian team at the World Cup in Qatar, allegedly blocked, assaulted and raped the informant in a bathroom in the club’s VIP area, according to the newspaper. El Periodico. He sought out his friends and security at the club after the incident.
The nightclub’s security team called the Catalan police (Mossos d’Esquadra), who took a statement from the victim. A camera worn on a police officer’s uniform accidentally recorded the first version of the victim’s case, confirming what was claimed in the official statement. The woman also underwent a medical examination in the hospital. Daniel Alves left the scene before police arrived.
According to the Spanish press, the contradiction in the right-back’s testimony was decisive for the prosecutor to ask for his arrest and for the judge to accept. In early January, the player gave an interview to the program “Y Ahora Sonsoles”, on Aerial 3in which he confirmed that he was in the same nightclub as the woman accusing him, but denied touching the complainant without her consent and claimed he did not even know her.
In the statement, however, according to the Spanish media, the athlete claimed to have been with the woman, but without sexual intercourse. Later, he admitted to the sexual act, but claimed the relationship was consensual. According to the radio chain of the ser, internal surveillance images of the place confirm that Daniel Alves spent 15 minutes with the woman in the bathroom. The collected material found traces of semen both inside and on the informant’s dress.
Pumas, from Mexico, have announced that Daniel Alves’ employment contract with the club has been terminated for cause.
Daniel Alves’ defense, led by the lawyer Cristóbal Martell, has until Tuesday 31st to present an appeal to the 15th bar of Barcelona and ask for the client’s provisional release.
The deadline has been extended to give the new team of lawyers time to review the case they took to court on Wednesday. The appeal is a further piece of a complex process in which the new Brazilian defense will try to redesign the strategy.
