Haddad says Carf model that benefited taxpayers was a ‘shameful’

The finance minister, Fernando Haddad, said this Tuesday that the judgment model that had been used by the CARF (Fiscal Resources Administration Council) was a “disgrace”, for the benefit of taxpayers in theses which he classified as ” absurd”.

The minister referred to the casting vote, which expired during the Jair Bolsonaro government, which authorizes the collegiate president to cast a casting vote in trials. A provisional measure by the new government has reactivated this instrument, putting an end to the automatic benefit for taxpayers in the event of parity.

Carf is responsible for tax litigation at an administrative level.

“What is happening to CARF is a shame, there is no country in the world with this dispute resolution system,” he said, also criticizing the participation of taxpayer representatives in the processes.

According to the minister, from 20 to 30 companies have benefited from “absurd” theses and which have overturned the jurisprudence of the Superior Court of Justice and the Federal Court.

This Tuesday, the Federal Revenue Agency had already released a memo to say that the fact that Carf has been around for 100 years does not mean that the body is working well.

“The appointment of almost all taxpayer representatives by a few business confederations does not allow us to recall the diversity of positions”, reads the tax note, which also criticizes the six-year average delay for the conclusion of the judgements.
