SP issues a law requiring bars and nightclubs to help at-risk women

Facilities must offer victims of sexual assault or harassment an escort to their car or other means of transportation or notify the police

The Governor of São Paulo, Tarcisio de Freitas (Republicans), sanctioned this Friday 3, a law that obliges bars, restaurants, discos and events to adopt measures to help women who feel at risk. The text will be published in the edition of Official Gazette of the State this saturday 4.

According to the project of the deputies Coronel Nishikawa (PL), Marcio Nakashima (PDT) and Damaris Moura (PSDB), the establishments must offer the victims an escort to the car, another means of transport or notify the police. Venues should also post signs in women’s restrooms or any other environment, informing their willingness to help women who feel at risk. The aim is to combat harassment and various forms of violence against women, including psychological violence.

“The government of São Paulo will develop responsible work aimed at protecting women and the family. We will take care, pay attention to priority policies on health, social development, entrepreneurship and, above all, the fight against violence against women”, the governor said.

The initiative is inspired by the Spanish document No Callem (We are not silent, in Catalan), which applies measures to combat gender-based violence. The protocol has already been adopted by 40 establishments in Barcelona, including the Sutton nightclub, where player Daniel Alves allegedly raped a 23-year-old woman. The upscale nightclub followed the recommendations to the letter. The young woman left the nightclub by ambulance for a referral hospital. The employees who assisted the woman were trained following the protocol. Daniel Alves is arrested for sexual assault.

“Often, victims of violence find it difficult to seek help or support after an episode of physical, sexual or psychological assault. The more people are willing to take in these women, the more we will fight these practices and hold criminals accountable,” she said. the Secretary of State for Women’s Policies, Sonaira Fernandes.

The prison

Daniel Alves was arrested on January 20 after testifying in the sexual assault case against a woman in the early hours of last December 30th. The Public Prosecutor’s Office has requested the preventive detention of the 39-year-old athlete, without the right to bail.

The episode allegedly took place at the Sutton nightclub in Barcelona. The athlete allegedly blocked, attacked and raped the woman in a bathroom in the VIP area of the disco, according to the newspaper. El Periodico. The nightclub’s security team called the Catalan police. A camera worn on a police officer’s uniform accidentally recorded the first version of the victim, confirming the official statement. Daniel Alves left the scene before police arrived.

The contradictions in the right-back’s testimony were decisive for his arrest. On the “Y Ahora Sonsoles” program on the Antena 3 channel, the athlete confirmed that he had been to a disco, but said he did not know the alleged victim. In the statement, Daniel Alves changed the story and said that he was with the woman, but without sexual intercourse. Faced with some evidence, such as a tattoo described by the complainant, the athlete released a new statement and claimed the relationship was consensual.
