The singer asks for compensation equal to R$ 50 thousand; this is the second time Tiririca has been sued by Roberto Carlos
The justice of São Paulo asked, this Tuesday 18, the federal deputy of sedge (PL-SP) and the singer Robert Charles settle a lawsuit over a parody the comedian used in his political campaign last year. The singer is asking for compensation of R$ 50 thousand.
In the parody, Tiririca used the song “O Portão” to say that they would “vote again” for him. In the announcement, the re-elected deputy played the role of the singer himself, without using the name Roberto Carlos directly, but referring to the “king” and singing the parody. In the lawsuit, the singer claims that the parody implies that he would have voted for Tiririca and would have repeated the vote, leading the public to the idea of his false support for the candidate.
Judge Guilherme Madeira Dezem however did not feel that there was necessarily an association between Roberto Carlos and Tiririca in the play. He also cites an excerpt from a previous decision of the Federal Supreme Court (STF), in which an action on the rules of election propaganda in the press and on the Internet was judged.
In the rapporteur’s vote, Minister Luiz Fux, in February 2022, declares that “election advertising is a central mechanism of a healthy democratic regime. Through it, a wide range of priorities are presented to the population, according to the platforms promoted by each candidate, to be chosen by the electorate as pillars of their community’s destiny for years to come.” Thus, the judge says he tends to favor freedom of expression in relation to electioneering matters.
The trial began in September 2022, while Tiririca was still running for re-election.
OR Earth sought contact with the singer and the deputy, but so far there has been no response. The space remains open.
Second time
In 2014, the singer Roberto Carlos, through the producer Emi Songs do Brasil, had already filed a lawsuit against the comedian Tiririca for the same reason. At the time, the plaintiff of the action claimed that copyright infringement also occurred due to the use of the song “O Portão”.
Less than a year later, in March 2015, Judge Márcio Teixeira Lago upheld the appeal and sentenced Tiririca not to use the song in its election ads, as well as seeking material damages for the use and alteration of the construction text. The case went to trial in two instances and, according to the STJ website, was referred to another court.
