The recent decision of the Court of Justice of Rio de Janeiro, which determined the global suspension of the reproduction of the song “Million Years Ago”, by the British singer Adele, as it was considered plagiarism of the song “Mulheres”, by Toninho Geraes, represents a stone significant milestone in the defense of copyright.
Judge Victor Agustin Jaccoud Diz Torres, of the 6th Corporate Court of the Capital, recognized the similarity between the melodies of the two works and ordered the immediate removal of the song from all streaming and sharing platforms, under penalty of a daily fine of R$50,000. in case of non-compliance.
For entities that defend copyright, such as the Brazilian Association of Music and Arts (ABRAMUS) and the Central Collection and Distribution Office (ECAD), the ruling constitutes an important precedent in the fight against infringement of intellectual rights . It highlights the effectiveness of the Brazilian legal system in recognizing and sanctioning acts of plagiarism, ensuring that authors are duly compensated for their works.
Furthermore, the decision highlights the need for global awareness of the importance of copyright, especially in an increasingly digital and interconnected music market.
The removal of a song by an internationally renowned artist like Adele from digital platforms demonstrates that copyright infringement will not be tolerated, regardless of the notoriety of the people involved. The provision may also encourage other composers to seek justice in similar cases, strengthening the culture of respect for artistic and intellectual creations.
