Given the recent repercussion on the process filed by Milton Nascimento against Cruzeiro Esporte Clube, we clarify that this is a legitimate action for unauthorized use of his musical work in an advertising campaign of the club, aired on January 1, 2025.

The music was used to announce the hiring of a player clearly promotional, without any authorization or attempted prior dialogue, which constitutes direct violation of the copyright law (Law 9.610/1998). Friendly resolution attempts were made, but were ignored.

We reiterate that music is work, livelihood, intellectual property. Just as a soccer player is paid for his craft, composers and artists also have the right to decide when, how and by whom their works can be used.

In such cases, it is necessary to separate idolatry, and if it understands that the club, beyond feeling, is a company/brand, which aims and has profits, and music, beyond the entertainment it generates, is a serious work, an assets of the author and source of income.

It is curious to note how there is still difficulty, by many, to understand music as a profession. To make this logic clearer, we propose a simple analogy: Imagine if someone went into a large supermarket chain belonging to the club owner, take the shelves products and, upon arriving at the cashier, request the items for free, for the sake of the team. Would it be accepted? Or even request players to play or run advertising campaigns without their proper remuneration, just for love.

This is exactly what happens when the free use of a business work for commercial purposes is required in the name of an alleged tribute.

We deeply regret the distilled hatred on social networks against Milton, with step and offensive attacks, which have nothing to do with the merits of the matter. Criminal comments are being registered and legal measures will be taken individually. The internet is not land without law.

This is not a fight for money. It is a legitimate defense of artistic work, copyright and respect for the profession.
