Colbert’s comment came days after seven members of Colbert’s team, including Smigel, were arrested at the Longworth House office building after closing for the night. The team previously recorded interviews with members of Congress.
“His interviews on Capitol Hill were authorized and pre-scheduled by congressional aides to the members interviewed,” said a CBS spokesperson. “After leaving the members’ offices for the last interview of the day, the production team remained in the hallways to film the comics and other final comic elements when they were arrested by the Capitol Police.”
However, the US Capitol Police charged them with trespassing, citing that they were in the hallway without an escort or official identification. The USCP added in a statement that they may file additional charges.
“This is an active criminal investigation and may lead to further criminal prosecution after consultation with a US attorney,” the statement said.
