Minister Cármen Lúcia was the fourth to share vote and third to position himself favorably for the punishment to all defendants
THE First class of Supreme Federal Court (STF) formed, on Thursday, 11, most of votes to condemn the former president Jair Bolsonaro and seven more allies in the criminal plot criminal action.
Most were formed with the minister’s vote Cármen Lúcia. With the minister’s understanding, the score for the condemnation of all defendants is in 3 votes to 1. The last vote, which will then be delivered by the minister Cristiano ZaninPresident of the Board.
In the two previous sessions, Alexandre de Moraes and Flávio Dino manifested themselves for the condemnation of all the defendants. Luiz Fux acquitted Bolsonaro and five other allies and voted for the condemnation of Mauro Cid and the general Braga Netto for the crime of abolition of the Democratic Rule of Law.
As published by Agência Brasil, the time of penalty has not yet been announced and will be defined only at the end of the votes of the five ministers, when the so -called dosimetry is made. In case of conviction, penalties may reach 30 years in prison in closed regime.
Vote of Cármen Lúcia
In her demonstration, the minister said that the trial of the coup plot refers to the past of Brazil, with institutional ruptures.
“What is unprecedented in this criminal action is that it pulsates Brazil that hurts me. The present criminal action is almost a meeting of Brazil with its past, with its present and its future in the area of public policies of state organs.”
Cármen Lúcia also pointed out that Bolsonaro and the other defendants cannot question the legitimacy of Law 14.197/21, a norm that defined the crimes against democracy and was used by the Attorney General’s Office (PGR) to base the accusation.
The norm was sanctioned by the former president and the defendants Anderson Torres, Braga Netto and Augusto Helenoformer government meters.
“It’s not just legitim [a lei]as it can not be said that it was unknown that they tried to pay attention against democracy. Four of the eight defendants are exactly the plaintiffs, those who have the autograph. ”

The minister also said that the scammer acts were the result of a “set of events” against democracy.
“January 8, 2023 was not a banal event after a Sunday lunch when people went for a walk.”
“Cabal Proof” against Bolsonaro
The minister stated that there is “full proof” of the participation of former President Bolsonaro and the other accused in a “criminal contract.”
“The Attorney’s Office has made a full proof that the group led by Jair Messias Bolsonaro, consisting of key figures of government, the military and intelligence bodies, developed and implemented a progressive and systematic plan of attack on democratic institutions in order to harm the legitimate alternation of power in the 2022 elections, especially the judiciary.”

In addition to Bolsonaro, the defendants are:
- Alexandre Ramagem-former director of the Brazilian Intelligence Agency (Abin);
- Almir Garnier- Former Navy Commander;
- Anderson Torres-former Minister of Justice and former Security Secretary of the Federal District;
- Augusto Heleno-former Minister of the Institutional Security Office (GSI);
- Paulo Sérgio Nogueira-Former Defense Minister;
- Walter Braga Netto-former Minister of the Civil House and Defense and candidate for Bolsonaro’s deputy on the 2022 plate;
- Mauro Cid-former Bolsonaro orders of orders.
All were accused of the following crimes:
- lead or integrate armed criminal organization;
- violently pay against the Democratic Rule of Law;
- coup of state;
- Damage qualified by violence and serious threat;
- deterioration of listed assets.
Added, penalties can exceed 40 years in prison.
The exception is the case of former ABIN director Alexandre Ramagem who is currently federal deputy. He benefited from the suspension of part of the accusations and responds only to three of the five crimes. The possibility of suspension is provided for in the Constitution.
