Klara Castanho wins the case against Antonia Fontenelle for moral damages

Actress Klara Castanho scored a significant victory on Friday afternoon (6/23), in a lawsuit against Antonia Fontenelle. The influencer was ordered to pay BRL 50,000 compensation to Klara for unwanted public exposure, related to sexual abuse culminating in pregnancy.

Bolsonarista Antonia Fontenelle, who has already applied for a vacant post as federal deputy for Rio de Janeiro, has been accused of violating Klara’s privacy by publicly revealing the sexual assault suffered by the actress and the subsequent delivery of her baby girl for adoption . The decision was handed down by Judge Flávia Viveiro de Castro, of the 2nd Civil Court of Barra, in the west zone of Rio de Janeiro, but it is still possible to appeal.

During the trial, Klara was moved to watch excerpts from the live broadcast in which Fontenelle criticizes her for having given up the newborn, the result of sexual violence, for adoption. The influencer even accused the actress of “abandonment of the incapable”.

The sentence was pronounced on the basis of cohabitation, the offense to the principles of human dignity and the defendant’s lack of solidarity.

criminal proceedings continue

In addition to the lawsuit for moral damages against Fontanelle, Klara Castanho has also filed a criminal complaint against Leo Dias, Antonia Fontenelle and Adriana Kappaz, known as Dri Paz, for slander, defamation and injury. The allegations are based on the actress’s exposure to news stories posted on the Internet.

Klara was forced to go public to reveal what happened after the publications. In June of last year, she released what she called “the most difficult story of my life,” revealing that she was raped, became pregnant and given the baby up for adoption. The confession was made after the news broke with the exposure of the actress.

The defense of the actress claimed that Leo Dias insulted the artist by inferring “that Klara Castanho would be an actress ‘who sells an image that everyone thinks is holy’, who has a ‘story’ and that what she has done is of ‘losing faith in humanity'”.

Fontenella was even worse. “He didn’t want to look the little girl in the face,” said the Bolsonarist influencer on YouTube, classifying the story as “monstrous” and a crime. “Bringing a child into the world and not wanting to see him and throwing him away by chance is a crime, yes, only those who have never been to a shelter find this adoption story cute, especially when it comes to a black child. The name of this is abandonment of the incompetent,” he said.

Dri Paz followed the same line, posting a video on the social network Kwai which “attributes” the crime of abandonment of incapable to the actress. She allegedly claimed that the young woman she paid to “disappear with the child,” which constitutes defamation and slander.

Klara followed all the procedures and acted in accordance with the law to donate the child resulting from the rape, and never wanted the case to be made public.

The sentence request provides that Leo Dias, Antonia and Adriana reach an agreement with the Public Prosecutor’s Office, agreeing to immediately serve the sentence, which could range from fines to social services.
