Real estate auction specialist, Pedro Gomide, explains how the procedure for auctioning a property works. “First, the debtor is informed of the delay and has the opportunity to pay off the debt. If this does not happen, the bank consolidates ownership of the property and brings it up for auction. After the consolidation, the debtor can no longer pay late installments, but you can still pay off the entire debt by a previously set date. In this case, the asset would be repurchased”, explains the expert.
Scenarios in which a property risks being auctioned
The real estate auction takes place for the forced payment of debts. In this way, the main reason that can lead the asset to be sold is the default of the obligations by the debtor. In addition to financing delays, factors such as business debts, non-payment of child support, criminal conduct, and mortgage or debt security can also lead to loss of property. “Employment cases occur, for example, when the worker has his rights denied by bosses. He can appeal to court, and if the employer does not have the cash value, the property can be pledged for the dismissal”, explains Gomides.
Possibility to appeal the decision
Incidentally, when the property is consolidated in the bank’s name or pledged by the court, there are still alternatives for the debtor to recourse. Once you are aware, the first step is to consult a lawyer who will be able to analyze the case and identify any irregularities in the process. “The bank must communicate the overdue installments to the creditor after the third consecutive month. Failure to communicate this delay before the consolidation, as well as the subsequent failure to communicate the dates of the auction, constitute grounds for nullity or suspension of the auction”, finally explains the auction expert. In addition, the bank must meet certain pre-established deadlines between the notification and the consolidation of the property for sale.
Finally, it is worth mentioning that the property of Guta Stresser, from “A Grande Famíia”, valued by the town hall for just over R $ 2 million, was sold at auction for R $ 1,065,528.93.
