One crime of rape We talked about it again, after the presenter Tiago Pavinatto is sacked by Jovem Panthis week. Pavinatto offended Judge Airton Vieira who voted to acquit a farmer accused of committing the crime against a 13-year-old and subsequently refused to retract on air.

The rape case occurred in February 2011 in Pindorama, São Paulo. The farmer, whose name has not been disclosed, was spotted on the roof of a pickup truck with the 13-year-old victim and another 14-year-old teenager. The two were allegedly paid to have sex with the elderly man.

Initially the farmer was sentenced, in the first instance, to eight years’ imprisonment, but was acquitted by majority vote on appeal. According to what was disclosed at the time, the defense of the elderly man claimed that the young woman was a call girl and that the defendant did not know that she was under 18 years old.

The argument used by the TJ for the acquittal was that it was “believable” that the man, 76 years old at the time, had been wrong about the victim’s age. During the decision, which took place in 2014, Judge Airton Vieira was the speaker of the trial and voted in favor.

The acquittal has generated revolt in the organizations that defend children’s rights in the city. At the time, the Conanda (National Council for the Rights of the Child and Adolescent) published a repudiation note: “The accused has committed the crime of violating the rights of the child and should be punished for it. There was sexual exploitation, which is a heinous crime. The defendants should have been sentenced in an exemplary manner”.

Pavinatto’s comments

During the presentation of the program First line by young Pan, Host Tiago Pavinatto called the judge a ‘tramp and pervert’. Shortly before the end, the broadcaster’s management had asked for a retraction and, live, Pavinatto had said that he would not do it.

“House management is asking Judge Airton Vieira for a retraction, and I’m not going to, okay? Here I make it clear: I won’t retract a person who earns public money, frees a pedophile and continues to call the thirteen-year-old victim a whore. I refuse to do that,” Pavinatto said.

After the repercussions, in a note, Jovem Pan confirmed that he had fired Pavinatto and commentator Rodolfo Mariz, who cried live commenting on the case. On his Twitter profile he said that he was not fired and that he will never apologize for the “revolt”.

“I said, calmly, that I would rather lose my contract than lose my decency,” he wrote.
