The court denies the request to demolish the Clodovil villa in Ubatuba

OR Court of Justice of Sao Paulo (TJ-SP) rejected the request to demolish the villa in Ubatuba, on the north coast of São Paulo, which belonged to the fashion designer and television host Clodovil Hernandes. The property has been abandoned since his death in 2009.

The case was judged last Monday 11th by the Special Group of the Environmental Law Chambers of the Court of Justice of São Paulo, which rejected the request.

The request for total demolition of the property, which is located in an environmental protection area, was made by the lawyer Public Prosecutor of Sao Paulo (MPSP) after part of the building was demolished in 2021, by order of the Court.

The MP argued that there had been a mistake in defining the area to be demolished and that new evidence demonstrated the need for a total demolition of the property. The house has already been valued at R$1.6 million. It was sold at auction six years ago, but was never transferred to the new owner and is unused.

According to the TJ-SP document, to which the Earth had access, a “possible error in the delimitation of the area that was included in the Serra do Mar State Park at a previous time, i.e. the preparation of the reports more than 20 (twenty) years ago does not authorize the reopening of the evidentiary investigation after the final sentence of the sentence”, according to the vote of the rapporteur Luis Fernando Nishi.

In addition to him, judges Paulo Alcides, Nogueira Diefenthaler, Aliende Ribeiro, Isabel Cogan, Paulo Ayrosa and Ruy Alberto Leme Cavalheiro participated.

Auction

After Clodovil’s death in 2009, the Sao Paulo court authorized the auctioning of the designer’s villa to pay off the debts he left behind. In 2017, Thalita Daiane de Melo acquired the property with an offer of R$750,000. However, she tried to cancel the auction and was never able to use the space.

At the time, Thalita’s defense argued that the client had been deceived, as she had only purchased the right to use the area and not ownership of the property itself.

The request to cancel the auction was rejected and, this year, the Court ruled that the right to use the property be transferred to Thalita.
