“Considering that, in fact, this is what happened, Gusttavo Lima is a free man because he has only one investigation against him. He can travel, he can move anywhere, he can live a normal life, he is just a person who is under investigation,” Oliveira Lima reinforced.
For Judge Andrea Calado da Cruz, the singer gave ‘hostel to fugitives’, demonstrating ‘an alarming lack of consideration for justice’.
The criminal lawyer underlines it It is necessary that the investigation presents new incriminating facts in order for there to be a new arrest request against the singer.
“The police cannot simply file a new request for arrest because the previous one was simply revoked. There should be a new fact that gives rise to this new request for arrest. Let me give you an example: suppose the police find a telephone conversation that shows that Gusttavo Lima was aware of an escape. This would be a new fact and, yes, it can be used to request the arrest, but it must be a new fact, not a simple indication,” Oliveira Lima said.

The criminologist Eugênio Malavasi considers the already revoked request for preventive detention against Gustavo Lima to be ‘illegal’.
“The emphasis that I make from the outside, as a lawyer who has carried out an analysis from the outside, is in my opinion the total illegitimacy of the reasons expressed in the decision that decreed the preventive detention”, he stated, continuing:
“In my opinion, this arrest violates not only the procedural dictates, which establish this type of restrictive precautionary measure which is preventive detention, a provisional detention therefore, before the courts declare him guilty. He has not even been reported, so he is only and exclusively under investigation”, Malavasi reiterated.
“The reason why this arrest, in my opinion, is absolutely illegal is that it violates procedural rules, violates the Code of Criminal Procedure and, above all, the Federal Constitution, which establishes the presumption of innocence as a constitutional principle,” the criminologist concluded.
What Gustavo Lima’s defense says
In a note sent to EarthGusttavo Lima’s defense said they accepted the measure “with great calm and a sense of justice.”
Once again, the singer’s lawyers have reinforced their dissatisfaction with the decision made by Judge Andrea Calado da Cruz, of the 12th Criminal Court of Recife, and have stated that “it has established a series of presumptions contrary to everything that has already been presented in the case, contradictory, including the statement of the Public Prosecutor’s Office on the case.”
The statement also stressed the innocence of the compatriot: “Gustavo Lima’s relationships with the companies under investigation were strictly for the exploitation of the image and resulted from the sale of an airplane.
