Monark was defeated in the court case asking Google to remonetise its YouTube channel. The measure was taken late last year after Monark defended the legalization of the Nazi party in Brazil.
At the time, the youtuber also said that “if the boy wants to be anti-Jewish, I think he had the right to be”. The speech resonated on the internet and was interpreted as criminal.
Monark says the demonetization was “clear persecution” and that it “accelerated the so-called wipe movement” that he began to experience on the internet.
In their defense, lawyers Victor Lourenzon, Rafael Enjiu and Paulo Mendes questioned whether a private company could take the lead.
“Can the company, which practically has a monopoly on social video, without having any control by the state, have absolute and unlimited power to decide what it deems offensive or not in relation to freedom of expression, to the point of ‘ cancel a person and cancel any right to monetize their channel?” said lawyers for Monark, who also said Monark did not engage in “hate speech or fake news.”
On the other hand, the company Google has classified the youtuber’s video as a “disservice”: “When trying to publish controversial videos, defending Nazi agendas. Freedom of expression finds limits in the legality of the propositions”, declared the company .
In the defense presented to the Justice, Google said that one of YouTube’s rules states that “the content creator must behave responsibly on and off the platform”. “And it violated that policy,” the company concluded.
Another important detail is that Youtube has not removed the video from the site, preserving freedom of expression, but preventing Monark from profiting from the radical guidelines, through demonetization.
It is worth mentioning that, after this controversy, he got involved in others. And after the posts expressing sympathy for the vandals who attacked the buildings of the Three Powers in Brasilia, their profiles were also blocked on social networks by decision of the Justice.
