TRE-SP has understood that Daniel Annenberg has left the PSDB without just cause
The Regional Electoral Tribunal of São Paulo (TRE-SP) unanimously decided to revoke the mandate of Daniel Annenbergbrother of journalist Sandra Annemberg, who is a councilor in São Paulo.
The justice understood that Daniel practiced party infidelity by disaffiliation without just cause. The MP, who was from the PSDB, left the party and joined the PSB. The lawsuit was filed by the PSDB, which said the disaffiliation was due to personal political interests.
Daniel has asked for disaffiliation claiming a substantial change in the ideological orientation of the party, which is allegedly moving away from its social democratic program. Judicial decision
In the opinion of the rapporteur on the matter at TRE-SP, Judge Silmar Fernandes, there has been no substantial change in the party’s ideology due to the suppression or modification of statutory provisions or programmatic precepts. However, according to the rapporteur, the testimony of the councilor’s defense witnesses did not present “concrete facts that support the existence of an essential change in the PSDB party programme”.
According to the jurisprudence cited in the sentence, it is necessary to demonstrate the repeated departure from the national orientation or attitude that the legend has historically assumed on a topic of significant political and social nature, changing one’s ideology, so that the just cause is configured as disaffiliation.
