According to an article published on the Notícias da TV website, judge Maria Rita Rebello Pinho Dias denied the request for judicial recovery that the entrepreneur presented at the beginning of this month. To the the debts of the former couple’s companies reach R$40 million.

According to the decision, Alexandre’s request was rejected because he filed the lawsuit without Ana Hickmann, also a partner of the companies, providing him with a power of attorney to resolve the matter. The judge also underlines that the entrepreneur, as a private individual, should not have submitted the request on behalf of the company.

“The shareholder, therefore, even if he is a director, does not have the legitimacy to request the Judicial Reorganization, nor the precautionary protection that precedes it, against the company, since his legal personality cannot be confused with that of the company of which he is part partner, therefore endowed with active legitimacy”, reads an excerpt of the decision published by Notícias da TV.
