Jenni Rivera’s children have suffered another setback in their lawsuit against their grandfather Pedro Rivera and record labels Cintas Acuario and Ayana Music, in which they claim millionaire rights for the alleged unfair exploitation of the late singer’s image, name and many musical themes.
According to information from the “Ventaneando” program, which had access to official court documents, the hearing was scheduled for November 22 the judge refusedbecause they did not present their arguments in time.
Pedro Rivera scores a victory
Jacqie, Mike, Jenicka and Jhonny claim that Cintas Acuario has not paid the corresponding royalties for many of their mother’s songs. However, in the counterclaim filed by Mr. Pedro Rivera explains why there is no debt.
According to the documents presented by patriarch Rivera, it is detailed that since 2005 Cintas Acuario had a rights agreement with the Fonovisa record company, which distributed Jenni Rivera’s material.
The contract stipulated that Fonovisa surrendered 50 percent of the rights to Ayana Musical, which in turn surrendered them to “La Diva de la Banda.”
In 2009 the agreement was amended by Fonovisafor which he began paying royalties directly to Jenni. However, Ayana Musical was not informed of the change and He continued to pay Jenni Rivera until 2013the year they realized they no longer had to.
It is explained that this Jenni’s children were ‘verbally’ notified and they had no problem sticking to it. However, in 2022 they ignored the notice and claimed the alleged missing rights.
Pedro Rivera points out in the counterclaim that, due to the four years they wrongfully sent the rights to Jenni Rivera because he was not aware of the changes in the contract with Fonovisa, his grandchildren would owe him almost fifty percent of the total amount.
Two hearings are scheduled for December, before the trial begins on February 11, 2025.
