Actress Klara Castanho is suing Antonia Fontenelle for denouncing her pregnancy and attacking her honor. She is asking for compensation of not less than R $ 100,000 from Fontenelle, for the statements made regarding the birth for adoption of her newborn baby, after the actress was the victim of a rape.

Fontenelle commented live on a trial whose secrecy is guaranteed by the law, as well as insinuating that the actress would have done something “monstrous” and committed the crime of “abandoning the incompetent”.

“In consideration of the very serious crimes ascertained against the Plaintiff, there is no doubt that, in the present case, all the conditions are met to sentence the accused to compensation for non-pecuniary damage in the amount of R $ 100,000.00”, reads in the appeal.

Castanho also asked for an injunction to remove the video in which the comments were made. But judge Flávia Viveiro de Castro, of the 2nd Civil Court of Barra, in Rio de Janeiro, understood that the determination to withdraw Fontenelle’s statements would be “a kind of censorship”.

However, the judge stressed in his order that, if one cannot “censor a speech, even if we disagree”, this “does not release anyone who publishes and issues an offensive opinion, or spreads a hate speech, produced and proved the facts, to be held responsible for what was disclosed “.
