The defense of Matteus Amaral, who participated in the Big Brother Brazil program, argues that he cannot be held responsible for the alleged racial quota fraud at the Farroupilha Federal Institute (IFFar), in Rio Grande do Sul. Lawyer Vivania Vasconcelos, who represents the former BBB, took a position this Wednesday (22) on the case which also involves Luciane Amaral, Matteus’ mother.
The case, which occurred more than ten years ago, was discussed again after the news that the Federal Public Prosecutor had forwarded the case to the Public Prosecutor of Rio Grande do Sul. The defense disputes this version, stating that the matter is “completely outdated, without any possibility of review by the Judiciary or other body that determines a possible sanction”.
The controversy gained notoriety when Matteus participated in the reality show last year. Both he and his mother enrolled as racial quota students in courses at the Federal Institute of Rio Grande do Sul. Luciane declared herself black to study agribusiness at the same institution as her son.
Matteus Amaral’s lawyer points out that he was not an adult at the time of the recording. “At the time of the events related to the use of racial quotas, Mr. Matteus Amaral was a minor, a circumstance which, in itself, excludes any possibility of criminal liability, since, according to Brazilian legislation, minors under 18 years of age are not criminally liable,” the defense stated.
The case began with a formal complaint from a human rights activist, who called for an investigation into the ideological falsehoods contained in Matteus’ racial-ethnic self-declaration. This practice constitutes a crime under the Brazilian Penal Code, as inserting false information into documents to obtain benefits can lead to sanctions.
The defense of the former BBB states that “no administrative, judicial or investigative proceedings relating to the aforementioned matter are currently underway. Furthermore, there is no information on new investigations or formal measures aimed at other people related to the case. If they exist, they have not been officially communicated to the person allegedly involved.”
According to the lawyer, Matteus’ registration was carried out by a third party “on the basis of the presumption of racial belonging, considering the existence of people of color in the family tree”.
No information was disclosed about who registered Matteus in the racial quota system, nor how the process was conducted within the IFFar at the time.
In response to the backlash, Matteus said he “recognizes the social relevance of the debate and expresses absolute respect for policies of racial inclusion. While he did not act knowingly or intentionally, he regrets what occurred and reaffirms his commitment to truth, learning and personal evolution.”
