The case in point is that of Kris Williams, a 51-year-old woman who lost her parental rights after raising the baby she planned with then-partner Rebeka Wilson for two years.
In an interview with today.comKris, who already has a 16-year-old son, said his ex-wife has expressed a strong desire to be a mother. “So we started planning and looking for different ways to make that happen. We wanted to have that biological connection and we found the perfect donor on a website,” she said. Months later, the couple entered into a contract with Harlan Vaughn, the future donor, and Rebeka’s pregnancy took place. Before the baby was born in 2019, the two were legally married and have talked about the different scenarios that could happen if Kris doesn’t adopt him. “But we both felt safe,” she recalled.

What she didn’t imagine, however, is that in the event of a divorce, she could lose contact with the child completely – and that’s what happened. In 2021 they broke up, Rebeka reported abuse and obtained a Victim Protection Order against her ex-partner, who denies the allegations. At the moment, she moved with the baby to the donor’s house, who filed a lawsuit to acknowledge paternity. The two also had another child together. Since November of that year, Kris hasn’t seen her son and laments: “If anything can open a hole in your soul, I’d say this is it.”
On the final day 13, Judge Lynne McGuire’s decision ratified the separation between Kris and the baby. “The reality is that the law provides a legal remedy available to Williams. She knowingly chose not to pursue it,” she wrote in her ruling. Kris didn’t opt for adoption before splitting up and the automatic right of married parents over their children does not apply to same-sex couples.
