Will it be possible to vote on the Health Plan Project this year? Lira and Duarte Junior will have a meeting with the industry


The president of the Chamber and the rapporteur of the text discussed the timetable for developing the proposal on Wednesday

The rapporteur of the PL of Health insurance, the deputy Duarte Junior (PSB-MA), met on Wednesday the 4th with the president of the Chamber of Deputies, Arthur Lira (PP-AL), to try to speed up the processing of the project in the Chamber. During the conversation it was agreed that the two would have a meeting with industry representatives on 27 October. The expectation is that the issue will be voted on by the end of the year in the Chamber’s plenary session.

The project’s rapporteur will hold a series of meetings with House leaders this week to try to speed up the proposal’s analysis in the plenary. Since the text is being urgently drafted, the report will be able to be voted on directly, without going through the House committees. The first meeting should take place in the next few days with the leader of the PT-PCdoB-PV federation, Zeca Dirceu. Duarte Junior also requested a meeting with the leader of the PSDB-Cidadania federation, Adolfo Viana (PSDB-BA).

The PL Health Plan has been worked on in Congress for about 17 years, without achieving any results. The first proposal on the topic, presented in 2006, had around 270 projects attached.



Last month the rapporteur presented the text of the report on the subject. Among the points highlighted, the report establishes a rule for the readjustment of collective plans, which currently occurs at the discretion of operators.

Regardless of the size of the contracts, the National Agency for Complementary Healthcare (ANS) can intervene if an exorbitant adjustment occurs, exceeding the latest percentage authorized by the agency for individual plans. In this case, ANS will notify companies to question the percentage and may ultimately veto it.

Duarte also provided for the prohibition of unilateral termination of the contract by companies in any type of contract, individual or collective, except in the case of fraud or delay in monthly payments for 60 consecutive days.

There is also a measure relating to the possibility of requesting tests from nutritionists, physiotherapists, speech therapists and occupational therapists. The text also provides for the implementation of a single medical record so that information can be shared between the private sector and the Unified Health System (SUS). The measure is a strategy to prevent patients from having to repeat tests already carried out in another network.

Duarte Junior’s report did not please companies in the sector. Last month, after the presentation of the text, the Brazilian Association of Health Plans (Abramge), the National Federation of Supplementary Health (FenaSaúde), the National Union of Institutes of Health Self-Management (Unidas), Unimed do Brasil and the Confederation of Sante Casas de Misericórdia, Hospitals and Philanthropic Institutions have released a statement criticizing the report presented by Duarte Junior.

“The report neglects the peculiarities of the supplementary healthcare sector and compromises fundamental pillars of its functioning, proposing, for example, a ban on the cancellation of collective plans by operators, and establishing rules for the adjustment of monthly fees which require greater specificity, technical improvement and actuarial analysis to understand the impacts”, reads the note.
