The change in labor legislation aims to meet the needs of families with school-age children
As the middle of the year approaches, many parents begin to plan family vacations, trying to align this period with their children’s school holidays. But after all, do parents have the right to make their holidays coincide with school holidays? The answer is yes, but with some important considerations.
According to the Consolidation of Labor Laws (CLT), the employer has the prerogative to determine the leave period of employees, as long as it complies with certain criteria established by law. However, there is considerable flexibility when dealing with employees with school-age children.
The CLT, in article 136, provides that the holiday period must be decided by the employer, but the employer must take into account the needs of the service and the employee’s preferences. In particular, the law also establishes that employees who have school-age children have the right to have their holidays coincide with their children’s school periods.
This arrangement is extremely important for families, as it allows parents to enjoy rest and free time with their children during the school holidays, strengthening family bonds and ensuring quality time together.
Michel Cury, vice president and general manager of Rocket Lawyer Latin America underlines that this flexibility represents a significant advance in legislation, promoting the well-being of families. “It is essential that employers understand the importance of this right and do their best to accommodate the leave requests of employees who have school-age children,” she says.
Parents who want to combine their holidays with those of their children should:
• Plan ahead: find out about the school calendar and communicate with the employer at least 2 months in advance;
• Talk openly with the employer: explaining the importance of being present during your children’s school holidays can increase understanding and willingness to comply with the request;
• Consult the union: check whether the collective labor agreement for the sector includes any clause that favors the granting of holidays in the desired period;
