Court gives couples 60 days to vaccinate their daughters, imposes fine of up to R$10,000


Both claim that vaccination could put their daughters at risk. The fine can vary between R$ 100 and R$ 10 thousand per day, which will be allocated to the Childhood and Adolescence Fund of São Bento do Sul (SC)




The Court of Justice of Santa Catarina (TJ-SC) has forced parents to vaccinate their daughters within a maximum of 60 days, under penalty of paying a fine of R$100 to R$10 thousand per day in case of non-compliance. The decision is from the Second Civil Court of the District of São Bento do Sul.

According to the parents, the vaccination puts their daughters’ lives at risk because it lacks “medical approval”. However, the argument was not accepted by the Court, which decided that it is necessary to immunize the children according to the immunization program of the Ministry of Health.

For the Court, the Constitution is clear in establishing that it is the duty of the State, society and the family to guarantee the safety of the child, as stated in the Statute of Childhood and Adolescence (ECA). It says that exemption from vaccination can only occur in one scenario, when there is a medical contraindication proven with a certificate.

The judge in the case also cited the Covid-19 pandemic, noting that if there were more assertive policies, many deaths could be avoided.

The case was closed by the Public Prosecutor’s Office and, in case of failure to comply with the directive imposed on the couple, the fine paid will be allocated to the Municipality’s Childhood and Adolescence Fund. It is possible to appeal the decision.
