The Court of Justice ordered the city to pay compensation of R$ 70,000 to the child’s parents
The Court of Justice of São Paulo has ordered the city of Jundiaí to pay R$ 70,000 in moral damages to the family of a child who received the wrong vaccine at a health center.

The decision was issued by Judge Vanessa Velloso Silva Saad Picoli, of the Public Finance Court of Jundiaí. In addition to the compensation of R$70,000, R$799 will also have to be paid for the hospitalization costs of the child.
According to TJ-SP, a five-month-old girl was supposed to be vaccinated against meningitis, but she received a vaccine against Covid-19. The vaccine she received is not recommended for children of this age, and the girl even received a dose much higher than that recommended even for adults.
Due to the error, her life is at risk, as the vaccine caused damage to her heart muscle. The child underwent tests and had to be hospitalized due to a myocardial injury, and will require cardiac monitoring throughout childhood.
According to the Court, the change in vaccines could leave consequences that have not yet been described in medical literature. The rapporteur of the appeal, Spoladore Dominguez, says that the parents are psychologically shaken by their daughter’s health.
Furthermore, he states that the failure to provide the service constitutes a “greater than normal inconvenience”, especially considering the family’s sense of impotence.
