The Court of Sao Paulo has decided to close the investigation into the death of the dog Jocaa 5-year-old golden retriever died during transportation on the Gol airline last April.

The decision responds to the request of the Public Prosecutor of São Paulo, according to which there was insufficient evidence to file a complaint of mistreatment. The information comes from TV Globo.
The judge who decided to close the police investigation was Judge Gilberto Azevedo de Moraes Costa, who argued that “there was no intention to mistreat the dog Joca”. “From the documents emerges a succession of negligent behaviors, deriving from negligence and imprudence, carried out by employees”, he stated.
“However, there is no evidence that the dog Joca was mistreated and suffered as a result of this circumstance. The employees who had contact with Joca after his arrival in Fortaleza reported that he was well and calm, without no apparent stressful situation,” the judge said.
The crime of mistreatment does not include the negligent modality, when there is no intention to act. For the crime there is only the intentional modality, when there is intention behind the act.
The dog was reportedly taken from Sao Paulo International Airport, in the town of Guarulhos, to Sinop, Mato Grosso. However, he ended up on a plane that flew to Fortaleza (CE). The dog’s journey lasted from 2 hours 30 minutes to 8 hours.
The Civil Police of Guarulhos concluded the investigation into the animal’s death in June. The final report highlighted “the effect of the error when loading the animal”, in a sealed transport box.

Joca case

Cardiogenic shock, or the inefficiency of the heart in pumping blood to the organs, is a consequence of hyperthermia (increase in body temperature) suffered by the animal. From that point on, cardiorespiratory arrest occurred and heart failure due to dehydration would occur. The report was attached to the newly closed investigation.
