However, according to the Consumer Protection Code (CDC), it is not always possible to replace a product, whether purchased for yourself or as a gift for someone.
Lawyer Ana Luiza Fernandes de Moura, member of the Celso Cândido de Sousa Advogados firm, explains the client’s rights related to exchanges. “In physical stores, the exchange will depend on the internal policy of each business. However, if there are flaws or defects in the purchased product, the deadline, according to Article 26 of the CDC, is 30 days for non-durable products, such as food and medicines, and 90 days for durable products, such as household appliances and electronic devices”.
When the acquisition is carried out online, the specialist details the legislation. “The deadline for exchanging virtual purchases under Article 49 of the CDC is seven days from the purchase or receipt of the product, regardless of the reason,” it says.
According to the lawyer, even if it is a gift, the rules do not change. “It will depend on the store’s internal policy, but it is important that when purchasing the gift, the consumer clarifies any doubts with the store regarding the dates and the possibility of exchange, keeping the label and tax coupons”, he adds.
According to Ana Luiza Moura, only in one case is the business obliged to change the item. “When there are faults or defects in the product, as long as you have not been informed in advance and clearly of any defects by the seller,” he emphasizes regarding promotions aimed at minor defects.
However, if the consumer still feels aggrieved, he can seek solutions to the case. “The customer should try to resolve the issue and contact the store or website provider directly. If the matter is not resolved, you should file a complaint with Procon or seek an attorney who specializes in consumer law.”
