From May, all employers of the CLT model have also been responsible for the mental health of their employees. This is what defines the latest update of the regulatory standard 1 (NR-1) of the Ministry of Labor and Employment (MTE).
The text states that in addition to physical, chemical and biological risks, companies should also pay attention to psychosocial factors such as stress, harassment and mental exhaustion. In practice, this means that employers should identify, classify and adopt measures to prevent the impacts of these factors on the mental and physical health of workers.
The supervision of compliance with the measures will be performed by the MT itself. In the event of irregularities, the ministry can apply fines up to $ 50,000 for each infringement committed, depending on the size of the company and the severity of the violation, as well as interdict sectors of the company if it has proven to be indispensable for the safety of workers. In more serious situations, employers are also subject to work, judicial and criminal processes.
To act in accordance with the new guidelines, companies must evaluate the work environment not only in relation to machinery and processes, but also to psychological pressure, overload and interpersonal relationships of their employees. According to Paulo Vieira, president of Febracis, a school preparation school, this new moment increases the responsibility to manage to map risk factors for health at work. “The changes are not only legal, but require concrete actions that directly affect the culture of organizations and workers,” he explains.
Brazil occupies the fourth position among the countries with the saddest professionals or with daily anger in Latin America, according to a study by Gallup consultancy. The data indicate that 46% of interviewees live in stressful situations every day. The study of people at work, conducted every year by the Adp Research Institute, underlines that 43% of the country’s professionals are uncomfortable to talk about mental health at work.
For Paulo Vieira, the NR1 update implies a significant cultural change in work reports in Brazil. “Companies will have to invest in the training of their managers and employees to increase the emotional safety of their teams. This movement will also be positive for companies, with consequent reduction in turnover, increase productivity and a better organizational climate,” he concludes.
The first text of NR-1 was created in 1978, with general provisions for the link between companies and employees who live within the CLT regime. The document has guidelines for risk analysis and health prevention measures at work, as well as guides for the creation of recurring training programs. The latest update of the standard has been effective from May 26th.
