PGR argues that the former secretary’s freedom could cause interference in the investigation.
The Minister of the Federal Supreme Court (stf), Alexander of Moraesdenied the defense’s request to Anderson Torres and maintained the pretrial detention of the former Secretary of Public Safety of the Federal District. This Wednesday’s decision (01) keeps Torres in indefinite pre-trial detention.
The minister claims in the text that his decision is “reasonable, adequate and proportionate to ensure public order and the expediency of criminal investigations”.
In prison since January 14, Anderson Torres is accused of keeping silent on the attacks on the headquarters of the Three Powers in Brasilia on January 8. At the time he still held the position of Secretary of Public Safety of the DF, from which he was removed after the episode.
On January 12, after a search and seizure warrant was issued, the draft decree was found in Torres’ residence for the establishment of the state of defense at the headquarters of the Superior Electoral Tribunal (TSE) by the former president Jair Bolsonaroin order to overturn the result of the 2022 presidential elections of which LJudge Inacio Lula da Silva won.
In Wednesday’s decision, Moraes points out that the Attorney General’s Office (PGR) warned of the possibility that, in the event Torres is granted his freedom, “put at risk the continuation of the investigation, the collection of evidence and, consequently, the prosecution”.
He further highlighted that the PGR believes that “the seizure of the document was only possible because Anderson Gustavo Torres was out of the country.” On the day of the attacks Torres was on vacation in the United States, returning only on January 14, two days after the seizure of the draft.
Regarding the document, Moraes also underlines that it is still necessary to carry out a papilloscopic analysis, which could demonstrate the responsibility of the former secretary “even if by voluntary participation and omission”constituting crimes, as specified by the Minister, of acts of terrorism, damage, criminal association, violent abolition of the democratic rule of law and coup d’état provided for by the penal code.
